Sans\u00fcr, \u0130\u00e7i\u015fleri Bakan\u0131n\u0131n demokrasi i\u00e7in kulland\u0131\u011f\u0131 tabirle, k\u0131lcal damarlara kadar i\u015fledi\u011fi i\u00e7in hi\u00e7bir engel tan\u0131m\u0131yor, hala daha \u00e7ok say\u0131da gazete ve dergi toplat\u0131l\u0131yor, dahas\u0131 yay\u0131nlar\u0131 durduruluyor. Bu yetmezmi\u015f gibi benzer nedenlerle \u015fimdilerde bir de \u0130nternet siteleri eri\u015fime engelleniyor.<\/p>\n<p>Mutlaka eskiyle yeni aras\u0131nda fark aramak gerekirse belki \u015fu s\u00f6ylenebilir: Eski yay\u0131n durdurmalar yay\u0131nlar\u0131n kom\u00fcnist, b\u00f6l\u00fcc\u00fc oldu\u011fu gerek\u00e7esiyle yap\u0131l\u0131yordu, \u015fimdilerde ter\u00f6rist oldu\u011fu gerek\u00e7esiyle. Sonu\u00e7 a\u015fa\u011f\u0131 yukar\u0131 ayn\u0131 olsa da, her d\u00f6nemin ayr\u0131 bir siyasi dili var. Bu yeni dilin en belirgin \u00f6rne\u011fi ise Ter\u00f6rle M\u00fccadele Yasas\u0131 (TMY). Bir i\u015fin i\u00e7ine ter\u00f6r, \u015fiddet kavram\u0131 girince her t\u00fcrl\u00fc hak s\u0131n\u0131rlamas\u0131 me\u015fruluk kazand\u0131\u011f\u0131ndan, sans\u00fcr\u00fc de me\u015frula\u015ft\u0131rman\u0131n yolu ter\u00f6rle m\u00fccadeleden ge\u00e7iyor. TMY&#8217;nin sans\u00fcr\u00fc d\u00fczenleyen 6. maddesinin \u00fc\u00e7 rauntluk son m\u00fccadelesi, Anayasa&#8217;n\u0131n 90. maddesinin de ne kadar anlams\u0131zla\u015ft\u0131r\u0131labilece\u011fini g\u00f6steriyor.<\/p>\n<p>1. Raunt: Anayasa Mahkemesi<\/p>\n<p>\u0130\u015fte bu yeni dilden yola \u00e7\u0131kan AKP h\u00fck\u00fcmeti de, ter\u00f6rle m\u00fccadelede zay\u0131f kal\u0131nd\u0131\u011f\u0131 ele\u015ftirilerine kar\u015f\u0131, 2006 y\u0131l\u0131nda 3713 say\u0131l\u0131 Ter\u00f6rle M\u00fccadele Yasas\u0131&#8217;nda temel hak ve \u00f6zg\u00fcrl\u00fckleri ciddi anlamda tehdit eden de\u011fi\u015fikliklere gitti. Bu de\u011fi\u015fikliklerden biri 5532 say\u0131l\u0131 yasan\u0131n 5. maddesiyle TMY&#8217;nin 6. maddesine getirilen ekti. Buna g\u00f6re &#8216;Ter\u00f6r \u00f6rg\u00fct\u00fcn\u00fcn faaliyeti \u00e7er\u00e7evesinde su\u00e7 i\u015flemeye alenen te\u015fvik, i\u015flenmi\u015f olan su\u00e7lar\u0131 ve su\u00e7lular\u0131n\u0131 \u00f6vme veya ter\u00f6r \u00f6rg\u00fct\u00fcn\u00fcn propagandas\u0131n\u0131 i\u00e7eren s\u00fcreli yay\u0131nlar h\u00e2kim karar\u0131 ile; gecikmesinde sak\u0131nca bulunan hallerde de Cumhuriyet savc\u0131s\u0131n\u0131n emriyle tedbir olarak onbe\u015f g\u00fcnden bir aya kadar durdurulabilir&#8217;.<\/p>\n<p>\u0130lk okuyu\u015fta teredd\u00fcts\u00fcz bir \u015fekilde bir sans\u00fcr h\u00fckm\u00fc oldu\u011fu anla\u015f\u0131lan bu h\u00fckm\u00fc eski Cumhurba\u015fkan\u0131 Ahmet Necdet Sezer, di\u011fer ba\u015fka h\u00fck\u00fcmlerle birlikte iptal istemiyle Anayasa Mahkemesi&#8217;ne g\u00f6t\u00fcrd\u00fc. Anayasa Mahkemesi, 18 Haziran 2009 tarihinde verdi\u011fi kararda bu talebi reddetti.(1) Kullan\u0131lan oylar ve gerek\u00e7eler a\u00e7\u0131s\u0131ndan ibretlik olan bu karar, baz\u0131 ezberleri bozmak i\u00e7in de hat\u0131rda tutulmas\u0131 gerekli bir metin. Anayasa Mahkemesi Ba\u015fkanvekili  Osman Alifeyyaz Aks\u00fct&#8217;\u00fcn -ve kar\u015f\u0131oy kullanan di\u011fer d\u00f6rt \u00fcyenin(2)- k\u0131sa ama \u00f6zl\u00fc kar\u015f\u0131oy yaz\u0131s\u0131n\u0131n \u00e7o\u011funlu\u011fu ikna edememesi, bu \u00fcyeyi demokrat tav\u0131r almamakla itham edenler a\u00e7\u0131s\u0131ndan alt\u0131 \u00e7izilmesi gerekli bir husus:<\/p>\n<p>    &#8216;Anayasa&#8217;n\u0131n 28. maddesinin birinci f\u0131kras\u0131nda bas\u0131n\u0131n h\u00fcr oldu\u011fu, sans\u00fcr edilemeyece\u011fi belirtilmi\u015f; d\u00f6rd\u00fcnc\u00fc f\u0131kras\u0131nda tedbir yoluyla da\u011f\u0131t\u0131m\u0131n \u00f6nlenmesi, be\u015finci f\u0131kras\u0131nda yay\u0131m yasa\u011f\u0131, alt\u0131nc\u0131 f\u0131kras\u0131nda toplatma, sekizinci f\u0131kras\u0131nda ge\u00e7ici olarak kapatma \u00f6nlemleri d\u00fczenlenmi\u015ftir. Buna g\u00f6re, bas\u0131n ve yay\u0131n organlar\u0131na y\u00f6nelik yapt\u0131r\u0131mlar Anayasa&#8217;da s\u0131n\u0131rl\u0131 olarak belirlenmi\u015ftir. Anayasada say\u0131lanlar d\u0131\u015f\u0131nda bas\u0131n \u00f6zg\u00fcrl\u00fc\u011f\u00fcn\u00fc s\u0131n\u0131rlay\u0131c\u0131 bir \u00f6nlemin yasalarla d\u00fczenleme konusu yap\u0131lmas\u0131na olanak bulunmamaktad\u0131r. \u0130ptal istemine konu kural\u0131n korumak istedi\u011fi hukuki yarar, esasen Anayasada say\u0131lan di\u011fer \u00f6nlemlerle yeterince korunmaktad\u0131r. Anayasal hak ve \u00f6zg\u00fcrl\u00fcklerin Anayasa h\u00fck\u00fcmlerinin s\u0131n\u0131rl\u0131 olarak \u00f6ng\u00f6rd\u00fc\u011f\u00fc nedenlerin ve \u00f6nlemlerin d\u0131\u015f\u0131nda s\u0131n\u0131rlamalara tabi tutulmas\u0131 yolunun a\u00e7\u0131lmas\u0131 halinde ise temel hak ve \u00f6zg\u00fcrl\u00fcklerin zamanla a\u015f\u0131narak yok edilmesi tehlikesi ortaya \u00e7\u0131kar.<\/p>\n<p>    Anayasa&#8217;da mevcut olmayan &#8216;durdurma&#8217; \u00f6nlemini i\u00e7eren kural, Anayasa&#8217;n\u0131n 28. maddesine ayk\u0131r\u0131d\u0131r.&#8217; (ab\u00e7)<\/p>\n<p>2. Raunt: Avrupa \u0130nsan Haklar\u0131 Mahkemesi<\/p>\n<p>Anayasa Mahkemesi&#8217;nden al\u0131nan icazetle uygulanmaya devam eden durdurma yapt\u0131r\u0131m\u0131n\u0131n ikinci dura\u011f\u0131 Avrupa \u0130nsan Haklar\u0131 Mahkemesi (A\u0130HM) idi. \u00dclkede \u00d6zg\u00fcr G\u00fcndem, G\u00fcndem, G\u00fcncel ve Ger\u00e7ek Demokrasi gazetelerinin sahipleri, yay\u0131n y\u00f6netmenleri ve \u00e7al\u0131\u015fanlar\u0131 taraf\u0131ndan a\u00e7\u0131lan davalar\u0131 birle\u015ftiren A\u0130HM, 20 Ekim 2009 tarihinde \u00dcrper ve Di\u011ferleri\/T\u00fcrkiye karar\u0131n\u0131 verdi. A\u0130HM, tedbir kararlar\u0131n\u0131n tek ba\u015f\u0131na (per se), A\u0130HS&#8217;nin ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fcn\u00fc koruyan 10. maddesine ayk\u0131r\u0131 olmad\u0131\u011f\u0131n\u0131; ancak bir gazetenin, yarg\u0131 organ\u0131 taraf\u0131ndan hen\u00fcz i\u00e7eri\u011fi bilinmeyen gelecek say\u0131lar\u0131n tamam\u0131n\u0131n yay\u0131n\u0131n durdurulmas\u0131 halinde durumun farkl\u0131 olaca\u011f\u0131n\u0131 belirtti. A\u0130HM&#8217;ye g\u00f6re; TMY 6(5) ve bunun ilgili ba\u015fvurularda uygulanmas\u0131, kat\u0131lmad\u0131klar\u0131 yarg\u0131lamada su\u00e7lu bulunan ba\u015fvurucular\u0131n(3) ileride de benzer su\u00e7lar\u0131 i\u015fleyecekleri varsay\u0131m\u0131na dayanmaktad\u0131r. Bu nedenle TMY&#8217;nin yapt\u0131r\u0131m\u0131 \u00f6l\u00e7\u00fcs\u00fczd\u00fcr. Bunun yerine, mutlaka gerekiyorsa ilgili say\u0131n\u0131n toplat\u0131lmas\u0131 veya su\u00e7 konusu makalelere s\u0131n\u0131rlama getirilmesi gibi \u00f6nlemlerle me\u015fru amaca ula\u015f\u0131labilir.<\/p>\n<p>A\u0130HM, Anayasa Mahkemesi&#8217;nin s\u00f6ylemedi\u011fini a\u00e7\u0131k\u00e7a belirtmi\u015f ve TMY&#8217;nin 6 (5) h\u00fckm\u00fcn\u00fcn bir sans\u00fcr h\u00fckm\u00fc oldu\u011funu saptam\u0131\u015ft\u0131r.<\/p>\n<p>Hikayenin buraya kadarki k\u0131sm\u0131 tan\u0131d\u0131k gelebilir. Ancak bizi 3 ay \u00f6nce verilmi\u015f bu karara ili\u015fkin yaz\u0131 yazmaya sevk eden ve sorunun g\u00fcncelli\u011fini korumas\u0131na neden olan husus, karar\u0131n anayasal niteli\u011fidir . \u00c7\u00fcnk\u00fc, A\u0130HM&#8217;nin saptamas\u0131 TMY&#8217;nin 6. maddesinin ba\u015fvuru konusu olaylara uygulanmas\u0131yla s\u0131n\u0131rl\u0131 de\u011fil. Sorun, yanl\u0131\u015f uygulamadan de\u011fil, 6. maddenin 5. f\u0131kras\u0131ndan kaynaklanmaktad\u0131r. Bunun i\u00e7in A\u0130HM, \u00dcrper ve Di\u011ferleri vakas\u0131nda pilot karar y\u00f6ntemini uygulamaya karar vermi\u015ftir. Pilot karar, A\u0130HS koruma sisteminin yap\u0131sal sorunlar\u0131n defalarca incelenmesi yoluyla t\u0131kanmas\u0131n\u0131 engellemek amac\u0131yla olu\u015fturan yeni bir karar tipi.(4) Bu usule g\u00f6re, Mahkeme bir yasa veya uygulama &#8216;\u00e7ok say\u0131da ba\u015fvuru yap\u0131lmas\u0131na neden olacaksa devletlere uygun \u00e7\u00f6z\u00fcm bulma yolunda ve Bakanlar Komitesi&#8217;ne kararlar\u0131n uygulanmas\u0131n\u0131 denetlemede yard\u0131mc\u0131 olmak amac\u0131yla, sistemik bir sorun ve bu sorunun nedenleri oldu\u011funu d\u00fc\u015f\u00fcnd\u00fc\u011f\u00fc durumlar\u0131 tespit&#8217; etmektedir.(5) A\u0130HM, \u00dcrper ve Di\u011ferleri davas\u0131nda da halen \u00f6n\u00fcnde konuyla ilgili yap\u0131lm\u0131\u015f ba\u015fka ba\u015fvurular oldu\u011funu saptam\u0131\u015f, sorunun sistemik bir sorun oldu\u011funu belirterek genel bir \u00e7\u00f6z\u00fcm \u00f6nerisinde bulunmay\u0131 gerekli g\u00f6rm\u00fc\u015ft\u00fcr. A\u0130HM, bu ama\u00e7la h\u00fck\u00fcmete karar\u0131n 35-45. paragraflar\u0131n\u0131 dikkate alarak TMY 6(5) h\u00fckm\u00fcnde de\u011fi\u015fiklik yapmas\u0131n\u0131 \u00f6nermi\u015ftir. Bu nedenle, \u00dcrper ve Di\u011ferleri sonras\u0131nda sans\u00fcr\u00fcn dayana\u011f\u0131 olan TMY h\u00fckm\u00fcn\u00fcn uygulama olana\u011f\u0131 kalmam\u0131\u015f, sans\u00fcr tescillenmi\u015ftir.<br \/>\n3. Raunt: Ulusal Mahkemeler; TMY 6 (5) Dimdik Ayakta<\/p>\n<p>Karar sonras\u0131, h\u00fck\u00fcmet TMY&#8217;yi de\u011fi\u015ftirmek y\u00f6n\u00fcnde bir giri\u015fimde bulunmam\u0131\u015ft\u0131r. \u0130\u015fin do\u011frusu, kan\u0131m\u0131zca \u00e7ok bir \u015fey yapmas\u0131na da gerek yoktur. 5170 say\u0131l\u0131 yasayla Anayasa&#8217;n\u0131n 90. maddesine eklenen son f\u0131kraya g\u00f6re &#8216;Usul\u00fcne g\u00f6re y\u00fcr\u00fcrl\u00fc\u011fe konulmu\u015f temel hak ve \u00f6zg\u00fcrl\u00fcklere ili\u015fkin milletleraras\u0131 andla\u015fmalarla kanunlar\u0131n ayn\u0131 konuda farkl\u0131 h\u00fck\u00fcmler i\u00e7ermesi nedeniyle \u00e7\u0131kabilecek uyu\u015fmazl\u0131klarda milletleraras\u0131 andla\u015fma h\u00fck\u00fcmleri esas al\u0131n\u0131r&#8217;.<\/p>\n<p>A\u0130HM karar\u0131, T\u00fcrkiye&#8217;ye ili\u015fkin oldu\u011fu ve Mahkeme a\u00e7\u0131k\u00e7a TMY 6. maddenin sans\u00fcr\u00fcn kayna\u011f\u0131 oldu\u011funu saptad\u0131\u011f\u0131 i\u00e7in karar\u0131n ulusal yasayla uyu\u015fmaz olup olmad\u0131\u011f\u0131n\u0131 tart\u0131\u015fmaya bile gerek yoktur. A\u0130HM&#8217;nin sistemik bir bozuklu\u011fu saptad\u0131\u011f\u0131, bunun bir yasa h\u00fckm\u00fcnden kaynakland\u0131\u011f\u0131n\u0131 ve bunun a\u00e7\u0131k\u00e7a sans\u00fcr oldu\u011funu saptad\u0131\u011f\u0131 bir durumda 90. madde uygulanmayacaksa maddenin uygulama alan\u0131 neresidir? \u00dcrper karar\u0131ndan sonra T\u00fcrk hukukunda TMY 6. maddesinin 5. f\u0131kras\u0131n\u0131n uygulanabilirli\u011fi kalmam\u0131\u015ft\u0131r.<\/p>\n<p>G\u00f6r\u00fcnen o ki, mahkemeler tam tersini d\u00fc\u015f\u00fcnmektedir. Uygulama g\u00f6stermektedir ki, fiilen tam tersine Anayasa&#8217;n\u0131n 90. maddesinin uygulama alan\u0131 kalmam\u0131\u015f. Ger\u00e7ekten de, T\u00fcrkiye \u0130nsan Haklar\u0131 Vakf\u0131&#8217;ndan Evren \u00d6zer, her zamanki titizli\u011fiyle, \u00dcrper karar\u0131n\u0131n verildi\u011fi 20 Ekim 2009 tarihinden y\u0131lsonuna kadar 9 gazete ve derginin yay\u0131n\u0131n durduruldu\u011funu saptam\u0131\u015ft\u0131r. Bu yay\u0131nlar\u0131n d\u00f6k\u00fcm\u00fc \u015f\u00f6yle:<\/p>\n<p>    \u00d6zg\u00fcr G\u00f6r\u00fc\u015f (17 Ekim 2009); Haftal\u0131k Ba\u011f\u0131ms\u0131zl\u0131k, Demokrasi, Sosyalizm i\u00e7in Y\u00fcr\u00fcy\u00fc\u015f Dergisi (26 Ekim 2009); Sosyalizm \u00dc Azadi (27 Ekim 2009); Azadiya Welat (30 Ekim 2009); Yeniden Sosyalist Demokrasi Gazetesi (25 Kas\u0131m 2009); Emperyalizme ve Oligar\u015fiye Kar\u015f\u0131 Y\u00fcr\u00fcy\u00fc\u015f (22 Kas\u0131m 2009); Kurtulu\u015fun Yolunda DevGen\u00e7 Dergisi (26 Kas\u0131m 2009); Ayd\u0131nl\u0131k Dergisi (10 Aral\u0131k 2009); At\u0131l\u0131m Gazetesi (11 Aral\u0131k 2009).<\/p>\n<p>Devam\u0131 \u0130nternet&#8217;te<\/p>\n<p>Sans\u00fcr d\u00fczeninin bir di\u011fer aya\u011f\u0131n\u0131 ise \u0130nternet olu\u015fturmaktad\u0131r. \u0130nternet Ortam\u0131nda Yap\u0131lan Yay\u0131nlar\u0131n D\u00fczenlenmesi ve Bu Yay\u0131nlar Yoluyla \u0130\u015flenen Su\u00e7larla M\u00fccadele Edilmesi Hakk\u0131nda Kanun&#8217;un 8. maddesi, tahdidi olarak eri\u015fim engelleme karar\u0131 verilebilecek su\u00e7 tiplerini saym\u0131\u015ft\u0131r. Bu su\u00e7lar aras\u0131nda TMY&#8217;nin 6. maddesinde say\u0131lan su\u00e7lar bulunmamaktad\u0131r. Ancak, \u00f6zel yetkili A\u011f\u0131r Ceza Mahkemelerinin 6. maddeye dayanarak eri\u015fim engelleme kararlar\u0131 verdikleri bilinmektedir. 5651 say\u0131l\u0131 Yasa&#8217;n\u0131n 10. maddesine g\u00f6re, bu yasa uyar\u0131nca verilen g\u00f6revleri y\u00fcr\u00fctmekle g\u00f6revli Telekom\u00fcnikasyon \u0130leti\u015fim Ba\u015fkanl\u0131\u011f\u0131&#8217;n\u0131n May\u0131s 2009&#8217;da yay\u0131mlad\u0131\u011f\u0131 son istatistiklere(6) g\u00f6re 197 site, 8. maddede say\u0131lmayan nedenlerle eri\u015fime engellenmi\u015ftir. Bu kararlar\u0131n \u00e7o\u011funun TMY 6. maddeye g\u00f6re verildi\u011fi tahmin edilmektedir. Nitekim, ge\u00e7en hafta kat\u0131ld\u0131\u011f\u0131m\u0131z bir toplant\u0131da yarg\u0131dan bir temsilci 5651&#8217;de de\u011fi\u015fikli\u011fe gerek olmad\u0131\u011f\u0131n\u0131 \u00e7\u00fcnk\u00fc TMY 6. madde uyar\u0131nca eri\u015fim engelleme karar\u0131 verilebildi\u011fini belirtmi\u015ftir.<\/p>\n<p>Temel hak ve \u00f6zg\u00fcrl\u00fcklerin k\u0131s\u0131tlamas\u0131n\u0131, TMY&#8217;ye k\u0131yas yoluyla \u0130nternet sitelerine de uygulaman\u0131n kabul edilemezli\u011fi bir yana, \u00dcrper karar\u0131 sonras\u0131nda \u0130nternet sitelerinin TMY uyar\u0131nca eri\u015fime engellenmesi \u00e7ifte hukuka ayk\u0131r\u0131l\u0131k i\u00e7erir hale gelmi\u015ftir. Ne var ki, bu alanda da 6. madde uygulamalar\u0131 artarak devam etmektedir. \u00d6rne\u011fin Ankara 11.
