“Frequent website bans continue to be a cause for concern. Judicial and administrative decisions block the entire website instead of filtering out unwanted content. YouTube has been banned since May 2008. Court cases are pending against Facebook, Google Sites and other sites.”
Genel olarak (sadece Internetle ilgili olmayarak) şöyle diyor rapor: “However, the Turkish legal framework still fails to provide sufficient guarantees for exercising freedom of expression and, as a result, is often interpreted in a restrictive way by public prosecutors and judges.”
“Some websites are frequently blocked by court order, highlighting the need for stronger guarantees of respect of freedom of expression with regard to access to the internet.”
“Regarding freedom of expression, including freedom and pluralism of the media, article 301 of the Turkish Criminal Code is no longer used systematically to restrict freedom of expression. However, there are prosecutions based on a number of other articles of the Criminal Code. There are insufficient guarantees in Turkish law to exercise freedom of expression in line with the ECHR and the ECtHR case law. Political pressures on the media and legal uncertainties affect freedom of the press in practice.”
Kişisel verilerin korunması ve telekulak konusuna da tekrardan değinilmiş: “With regard to respect for private and family life and, in particular, the right to protection of personal data, Turkey needs to align its legislation with the data protection acquis, in particular Directive 95/46/EC, and, in that context, to set up a fully independent data protection supervisory authority. Turkey also needs to ratify both the CoE Convention for the protection of individuals with regard to automatic processing of personal data (CETS No 108) and the additional protocol to it on supervisory authorities and trans-border data flow (CETS No 181). Wiretapping has reportedly been used extensively and records of it published in the press.”
“AB ilerleme raporunda ilk defa Türkiye’deki Internet sansürlerine değinildi ve YouTube dahil olmak üzere bir çok siteye erişim engellendiğinin altı çizildi. Raporda Internet ve websiteleri açısından düşünce özgürlüğünün daha kuvvetli bir şekilde korunması gerektiği belirtiliyor.” (Doç. Dr. Yaman Akdeniz)
